On March 5, 2025, the Legislative Assembly approved, in a second debate, bill number 23528, which explicitly regulates working from outside Costa Rica.

According to the provisions of the approved draft law, working from abroad may be requested by the employer and will require the employee’s express consent; if the employee agrees, the employer must fulfill all legal responsibilities to ensure an adequate working environment outside the country.

Regarding occupational risk insurance, the bill establishes that coverage for work-related risks will also apply abroad, and it is the employer’s responsibility to subscribe to extraterritorial coverage in the corresponding policies.

When will this law take effect? This draft law requires the signature of the President of the Republic and publication in the Official Gazette La Gaceta for the changes to become effective. Once the bill becomes law, an employer should adjust policies, internal regulations, contracts, and/or teleworking addenda to comply with the new provisions.
