The Board of Directors of the Competition and Antitrust Superintendence in Guatemala issued, through Resolution No. 11-2025, the Regulations of the Competition and Antitrust Law (the “Regulations”), which entered into force on December 30, 2025, with a gradual and deferred implementation, as provided under the Competition and Antitrust Law.
The Regulations are of general application to all economic agents subject to the Competition and Antitrust Law operating in Guatemala and set forth the elements necessary for its proper application, including:
- The scope of authority of the Competition and Antitrust Superintendence.
- The guiding principles of the competition regime.
- The criteria applicable to the investigation and sanctioning of anticompetitive practices, as well as the authorization of economic concentrations.
- The administrative procedures applicable to competition matters.
The issuance of the Regulations provides greater clarity and legal certainty to the competition regime in Guatemala and allows economic agents to anticipate the full application of the relevant provisions.
