The Constitutional Court is currently analyzing the constitutionality of articles 543, second paragraph, 545, 573, and 583 of the Labor Code because they could affect the guarantee of due process and the principle of constitutional reasonableness.
In both cases, it is questioned that the process does not include the possibility of appealing the decision issued by a Judge, which consists of the reinstatement order of a person with legal protection.
As these matters are under review, the labor processes in which the employee’s reinstatement has been requested have been suspended; said measure will be maintained until the Constitutional Court rules on the matter.
