{"id":8009,"date":"2022-06-03T12:15:05","date_gmt":"2022-06-03T18:15:05","guid":{"rendered":"https:\/\/www.blplegal.com\/?p=8009"},"modified":"2022-06-03T12:15:05","modified_gmt":"2022-06-03T18:15:05","slug":"06-2022-reforma-para-combatir-la-discriminacion-laboral-contra-las-mujeres-en-condicion-de-maternidad","status":"publish","type":"post","link":"https:\/\/blplegal.com\/es\/06-2022-reforma-para-combatir-la-discriminacion-laboral-contra-las-mujeres-en-condicion-de-maternidad\/","title":{"rendered":"Reforma para Combatir la discriminaci\u00f3n laboral contra las mujeres en condici\u00f3n de maternidad"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">El d\u00eda de hoy, viernes 03 de junio de 2022, se public\u00f3 en el diario oficial La Gaceta, la reforma de los art\u00edculos 94, 94 BIS, 95, 96, 97, 100 y la adici\u00f3n del inciso K) al art\u00edculo 70 del C\u00f3digo de Trabajo<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Conforme lo establece este cambio en la ley, todo patrono debe asegurarse de cumplir con los siguientes lineamientos:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Licencia por Maternidad:<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Se proh\u00edbe exigir una prueba m\u00e9dica de embarazo para el ingreso o la permanencia en el trabajo.\n\u2022 Brindar un permiso con goce de salario para que la trabajadora o padre encargado pueda asistir a servicios m\u00e9dicos.\n\u2022 La trabajadora podr\u00e1 optar por la reinstalaci\u00f3n o dar por terminado el contrato de trabajo con responsabilidad patronal.\n\u2022 Tambi\u00e9n, la trabajadora en per\u00edodo de lactancia tendr\u00e9 derecho a la cesant\u00eda y al cobro de da\u00f1os y perjuicios que se fijar\u00e1 en sentencia.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Licencia por Paternidad:<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 A los padres biol\u00f3gicos se les dar\u00e1 una licencia de paternidad de 2 d\u00edas por semana durante las primeras 4 semanas a partir del nacimiento de su hijo o hija.\n\u2022 En el caso de muerte materna, el padre biol\u00f3gico tendr\u00e1 derecho a una licencia especial posparto.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Sobre el Cuarto de lactancia:<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Contar con un cuarto de lactancia, sin importar el n\u00famero de trabajadoras.\n\u2022 Las empleadas en per\u00edodo de lactancia podr\u00e1n disponer de distintos intervalos a elegir para amamantar.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El d\u00eda de hoy, viernes 03 de junio de 2022, se public\u00f3 en el diario oficial La Gaceta, la reforma de los art\u00edculos 94, 94 BIS, 95, 96, 97, 100 y la adici\u00f3n del inciso K) al art\u00edculo 70 del C\u00f3digo de Trabajo Conforme lo establece este cambio en la ley, todo patrono debe asegurarse&#8230;<\/p>\n","protected":false},"author":2,"featured_media":22344,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[242,304,303],"tags":[],"class_list":["post-8009","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-blog","category-costa-rica-es","category-noticias"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.9 -
